This website is operated by Biddwell Technology Inc. as "stable.work”. The references to "we", "us" and "our" are references to Stable Technology Inc. as stable.work. References to "you" are references to you (i.e. the person visiting our website). If you are visiting our website on behalf of another entity (such as a company), then (a) you represent and warrant to us that you are an authorized representative or agent of that entity; and (b) references to “you” include you and that entity.

By using or accessing our website or services, you agree to these terms and conditions (as modified from time to time). Should you not agree with our terms and conditions, you must not use Stable.work or any of our services. You must read these terms and conditions before you use our website or services.
2. Scope
These terms and conditions are a legal agreement between us and you and apply to your use of our website. You must read and accept all the terms and conditions contained in this agreement and our privacy statement prior to registering with us and before offering to rent a property through our website. All the properties uploaded by you should match the actual properties they represent with no intention to mislead tenants. These terms relate to properties all properties list on Stable.work. The language of this Agreement is in English. Stable reserves the right to amend the terms and conditions without notice.
Passwords are generated upon the creation of user accounts and/or in the event of a property listing posted on Stable.work. You should not disclose or transfer your password outside your business and you must notify us immediately if you become aware of any unauthorised use of your user name and/or password.
Without prejudice to our rights, we may suspend your access to the website without liability to you if in our reasonable opinion such action is necessary to safeguard the website.
3. The Properties
When uploading a property onto our website you warrant that the particulars with regard to the property are full and true and not misleading.
If a deposit is required you must clearly set out the amount, By placing a property on our website you warrant that if a deposit has been taken, it will be protected in accordance with any statutory obligations, from time to time in force. You also agree that the tenancy agreement will comply in all respects with the Residential Tenancy Act of British Columbia and any other relevant tenancy legislation in place in your province or state (as amended).
4. Offer and Placement
All offers placed by a prospective tenant are subject to our acceptance. We reserve the right at all times and at our sole discretion to refuse to accept an offer for any reason and without liability to you or to the person placing the offer. The contract for the rental of the property will be between you and the tenant. We will not be a party to that contract and accept no liability in respect of that contract.
Our decision on any matter pertaining to the lodging of offers or offers and the conduct of the offers process is final save in the case of manifest or obvious error.
All offers will be in Canadian dollars per calendar month. Once set you will only be able to alter a minimum offer value before the first offer is received.
5. Descriptions and Property Information
You warrant the accuracy of the particulars of properties offered by you for rent and we are not responsible in any way for any misdescriptions that have been provided by you.
No statement, description, information, warranty, condition or recommendation contained in any document or communication made verbally by any of our employees shall be construed to supplement, vary or override in any way any of the provisions of these terms.
6. Tenant Referencing
Tenant referencing and subsequent invitation to offer is your responsibility. Any offer invites, offer acceptance, or lease agreement is the responsibility of the landlord.
7. Successful Winning Offers
The offering process will stop as soon as an active listing results in an offer being accepted.
Biddwell Technology Inc. is not responsible for any processes, contracts and/or agreements made between the winning tenant and the property owner/landlord.
8. Contact Details
You warrant that your contact details are accurately set out and are accessible from the link to the property on which the offer has been made.
9. Limitation of Liability
For any and all acts of omissions of our employees, agents or sub-contractors occurring in any year of this agreement shall be limited to the charges for the services during that year of this agreement.
To the extent prevented by law nothing in these terms shall limit or exclude our liability for personal injury or death caused by our negligent acts or omissions.
10. You Warrant
That the terms and all other details and documents uploaded by you are accurate and true and not misleading;
That you will not withdraw a property once the offering process starts;
11. Trademarks, Copyright, Intellectual Property
The Stable trademark remains our exclusive property and as such is protected by international and Canadian copyright and other intellectual property laws.
12. Data Protection
In accordance with the personal information protection act, all information will be kept confidential and adequately protected, unless otherwise ordered by a government agency.
13. Privacy Statement
We take the issue of the privacy and protection of personal data very seriously. We are committed to complying with all relevant Data Protection legislation. We use Internet technology (sometimes known as ‘cookies’) to store the information that you give us. We will not disclose any of your personal information to anyone other than within our group of companies, authorised service providers unless your use of our site authorises us to do so. We may from time to time contact you with regard to our products and services. You can at any time request that we make no further contact with you by emailing us at [email protected]. No form of communication over the internet is totally secure. We and our authorised 3rd party service providers will always use reasonable endeavours to protect the personal information that you give us but we cannot guarantee security totally and in registering with us you are acknowledging that you are placing your personal information on the internet at your own risk.
14. Post Offer Variance
It is possible that links on our website will lead to websites which are not under our control. In accessing these websites you leave our control. Accordingly, we can accept no responsibility or liability in respect of these other websites. You should take every reasonable precaution in accessing these sites and you are solely responsible for so doing.
Once a property has been rented via Stable.work any variances between you and the tenant are to be resolved jointly between you and the tenant. We are not responsible in any way for any disagreements or disputes that may arise during the term of any tenancy.
15. Indemnity
To provide you with our services, we may work with third party service providers. One of those third party service providers is Certn Holdings Inc. (“Certn”). You can find out more about Certn here: https://certn.co. Certn enhances our services by providing an automated, web-enabled tenant screening infrastructure that manages application and tenant screening processes which enable landlords to make tenancy decisions (the “Certn Services”). Depending on your use of our website and the Certn Services, you might receive a report produced by the Certn Services (the “Certn Report”).
If you access, use, or receive the Certn Services or Certn Report, you agree to fully indemnify, defend and hold harmless Certn, and its employees, officers, directors, and agents, from and against any and all claims, controversies, losses, liabilities, damages and harm arising as a result of: (a) your violation of any applicable law, regulation, rule or judicial or administrative order related to access to and/or use of the Certn Services; (b) your misuse, or any modification of the Certn Services constituting an infringement of a third party’s Intellectual Property rights; and (c) any business decision taken or made by you as a result of use or receipt of the Certn Services.
16. Web service availability
Due to the nature of the Internet occasionally we may periodically experience some technical difficulties or down time. Accordingly we cannot guarantee access to the site and cannot be held liable for any disruption to our service as a result thereof. Whilst we make all reasonable endeavours, with skill and care to ensure the accuracy and timeliness of your data, we have no control over viewings, management of properties, quality and safety of items advertised, the accuracy of listing or feedback or whether a user will complete the transaction and accordingly we cannot accept responsibility or liability in any way for any such matters.
17. Jurisdiction
These terms and conditions are governed by the laws of British Columbia and Canada therein, and to the non-exclusive jurisdiction of its courts.
18. Third Party Exclusion
You and We are the only parties to this agreement. Nothing in this agreement is intended to give any person any right to enforce any term of this agreement, other than (a) required information required to support other services within this product such as Tenant Referencing; and (b) as provided in section.
19. Definitions
In these terms and conditions, in addition to words defined above, the following words have the following meanings:
“Intellectual Property Rights” means copyright, database right, domain names, patents, registered and unregistered design rights, trade secrets, registered and unregistered trademarks, and all other industrial, commercial or intellectual property rights existing in any country and all the rights to apply for the same.
